Terms

1) CANCELLATIONS: Cancellation of any studio sitting or location photo session order within 7 days of photo session requires forfeiture of entire deposit, and within 3 weeks, of 50 percent of deposit, in the event that Jean-Pierre D'Zahr photographer is unable to secure another engagement for the same date.

2) PREVIEWS, NEGATIVES, AND HIGH RESOLUTION DIGITAL FILES: All previews are the exclusive property of Jean-Pierre D'Zahr photographer. Client agrees to pay for all unreturned previews, contact sheets, or proofs at the same rate as equal-size finished prints.

3) REPRODUCTION: Jean-Pierre D'Zahr photographer and client agree that neither will permit reproduction of any photographs for purpose of advertising or trade without the express written permission of the other. Model may use photos for composites, portfolio or Web Folio however each image must have accompanying photo credit, and if images are used in a Web Folio they need to have a link and ad banner linking back to this Web site.  Jean-Pierre D'Zahr photographer may, however display prints on the exterior or interior of photographer's studio and reproduce photographs in photographers' own printed brochures, Web pages, and portfolio.

4) LIABILITY: Jean-Pierre D'Zahr photographer agrees to return deposit to client in the evnt of nonpreformance or nondelivery caused by photographer. Client acknowledges that the dyes used in color photography, like all other dyes, may fade or discolor in time, and accordingly, client waives any and all claims resulting from such occurences.

5) EXCLUSIVITY: In cases of both studio and location photography, photographer shall be the only person permitted to photograph said photo session, so as not to interfere with photographer's execution of normal duties.

6) LOSE OR DAMAGES: D'Zahr Photography Studio accepts no responsibility for personal property lost or damaged. I imdenify Jean-Pierre D'Zahr and his staff for any personal injury while on the premises or while on location during a photo session.

7) PROMOTIONAL OFFERS: Specials, Discounts and Free offers are subject to complete and full payment of all invoices prior to receiving any Specials, Discounts and Free offers. Late payments, bad checks, credit card back charges and/or collections will VOID all promotional offers. Promotional offers are awarded to our Best customers.

8) ALL SALES ARE FINAL: Customer agrees that after viewing proofs of photos and making a selection for print orders or for digital files that customer agrees to accept said order making the sale final and complete and that DZahrphoto.com will NOT accept any returns for said orders as they have been deliver, accepted and used. Photos are for personal use or commerical use for the client DZahrphoto.com does NOT accept any returns.

9) RETURNED CHECK FEES: There is a RETURNED check charge of $75.00 for collection purposes and any bank charges are added to our fee.

10) LATE FEES & INTEREST CHARGES: Any outstanding invoices are subject to a monthly late fee of $100.00 plus, 6% interest per month from the billing date. We charge these rates only to customers who promise to pay but don't.  Since we don't like lending money like a bank we recommend you pay your invoices on time to avoid these extra charges. We also accept VISA and Mastercard for your convenience. Also any commercial use of works I've produced prior to paying your bill is subject to triple my regular rate of $2,400 per day. I'm glad you read these terms so we can remain friends.

11) FORM SELECTION CLAUSE: Any and All disputes must be resolved in the Superior Court of California of San Diego County.
